2. Acceptance of Terms

By using Profitify, you agree to be bound by the following terms and conditions. If you do not agree to these terms, do not use Profitify. Profitify may modify these terms from time to time, and your continued use of Profitify following any such modifications shall be deemed to be acceptance of such modifications.

3. User Conduct

a) As a User of the Profitify platform, you agree to use the platform only for lawful purposes and in compliance with these terms of service. You further agree that you will not engage in any activities or conduct that would interfere with or impede the use of the platform by other users. This includes, but not limited to, activities that may disrupt the normal functioning of the platform, activities that may cause harm or damage to the platform or its users, and activities that may violate the rights of the Company or other users of the platform.

b) You are responsible for ensuring that your use of the platform is in accordance with these terms of service and all applicable laws, regulations, and guidelines. Any unauthorized use of the platform may result in termination of your access to the platform and potential legal consequences. The Company reserves the right to take any appropriate legal action against individuals who violate these terms of service or engage in illegal or harmful activities on the platform.

c) using the Profitify platform, you represent and warrant that you will not engage in any activities that are illegal, fraudulent, or harmful to the Company, its users, or any third parties. You agree to indemnify and hold the Company harmless from any damages or harm arising from your use of the platform in violation of these terms of service or applicable laws.

4. Use of Service

As a User of the Site, you make the following representations and warranties:

i. You represent and warrant that you are of legal age to enter into a binding contract and have the capacity to agree to these terms and conditions.

ii. You agree to comply with this Agreement and all applicable laws and regulations, including but not limited to laws related to privacy, data protection, and intellectual property.

iii. You agree to provide accurate, complete, and up-to-date information when registering with the Site and to update your account information as necessary to keep it current and accurate.

iv. You acknowledge that you are solely responsible for maintaining the confidentiality of your account information, including but not limited to your username and password, and for restricting access to your computer or device.

v. You agree to accept full responsibility for all activities that occur under your account or password, whether or not you have authorized such activities. You agree to immediately notify the Company of any unauthorized use of your account or password or any other breach of security.

vi. You agree to indemnify and hold the Company harmless from any claims, damages, or losses arising from your violation of these terms of service or from any unauthorized use of your account or password.

a) Profitify provides a comprehensive brokage platform for the ecommerce platforms and affiliate marketers. The Company offers a range of marketing options. Through its platform, the Company provides Users with access to valuable market analysis, affiliate tools, and other resources that are designed to assist it users in making informed marketing decisions.

b) The Company's platform is constantly evolving and improving, with the goal of providing the most up-to-date and relevant information and tools to its Users. The Company strives to provide a secure and reliable platform for marketing, and to ensure that its Users have access to valuable information and resources they need to achieve their financial goals.

6. Accuracy of Information

Profitify is committed to providing the highest level of accuracy and reliability to its users in their markrting campaigns. We make every effort to ensure that the information provided on our platform is up-to-date, accurate and complete. Our team of experts regularly updates and verifies the information to provide our users with the most accurate and current market analysis and affiliate tools.

However, it is possible that certain information may be sourced from external sources, and in such cases, we cannot guarantee the accuracy and completeness of the information. The Company shall not be held liable for any errors or omissions that may occur as a result of such information. In the rare event that information from an external source is used on our platform, the Company will make every effort to clearly indicate the source and inform users of any potential inaccuracies as Profitify remains committed to providing our users with the best possible marketing experience, and we are confident that our platform will provide the information and tools necessary for successful marketing campaigns.

7. Security of Funds

At Profitify, we have zero tolerance to cyber and financial security threats because we prioritize nothing over our users Funds. Hence, the Company have implemented all necessary security measures to ensure the safety and security of user funds. Additionally, we regularly conduct security audits to identify and address any potential vulnerabilities in our platform. With Profitify, users can be confident that their funds are safe and secure.

8. Limitation of Liability

a) Profitify shall not be responsible or liable for any loss or damage, direct or indirect, incidental or consequential, arising out of the use or reliance upon any information contained in the Profitify platform or services for users without any financial holdings in Profitify.

b) Financial holdings mentioned in 8. a) above incorporate all assets of monetary value including any and all funds deposited or transferred into a user account on Profitify as well as any active or pending balances and or withdrawals. It is important to note that all financial holdings within our platform are fully secured and insured.

9. Announcement

a) It is the responsibility of all Profitify users to regularly and promptly review official announcements, news, promotions, competitions, new Listings/Delisting in order to stay informed and up-to-date. These announcements may be listed on the user's dashboard, the Profitify blog and news, and through email notifications and promotional materials.

b) Please be advised that failure to review these materials and ignorance or negligence of any announcements made may result in personal losses for the user. Profitify takes no responsibility or liability for such losses, and users are solely responsible for ensuring they are aware of all relevant information regarding activities on the platform.

c) To ensure the timely and effective communication of important information to our users, Profitify strongly encourages all users to regularly and promptly review the aforementioned sources of announcements

10. Intellectual Property

a) The Intellectual Property of Profitify is protected under copyright and other relevant laws. The Profitify website, platform, services, and all its contents, information, and materials belong to Profitify or its licensors and are therefore protected. However, it is permissible for users to utilize certain promotional materials for publicity purposes, provided that such use does not violate this Agreement as stated in 3. a) and c) of this Agreement. In the event that the use of Profitify's intellectual property is found to be in violation of this Agreement, the company reserves the right to take appropriate action as stated in 3. b) of this Agreement.

11. Plan and Pricing

• a) Trial Plan/Period

The trial plan/period offered by Profitify is designed to provide users with an opportunity to assess their marketing potential before committing to a purchase. The trial plan/period has a validity period ranging from a minimum of 3 days to a maximum of 30 days. During this trial period, all funds accumulated via affiliate marketing campaigns are not withdrawable. However, it's important to note that all earnings accrued during the trial period belong to the user, and withdrawals can be made upon the expiration of the trial period, provided the user has a compatible marketing account.

• b) Upgrade Policy

Profitify reserves the right to upgrade any active users to a higher plan based on their marketing efforts and success rate. This decision is made at the discretion of VetTraders and is aimed at ensuring that users are provided with the most suitable plan to match their evolving marketing needs and achievements.

12. Changes to These Terms of Service

Profitify reserves the right to modify these terms of service at any time. If we make material changes to these terms, we will notify you by posting the updated terms on our platform and/or by sending you an email. Your continued use of our platform after any changes to these terms will be deemed to be your acceptance of the updated terms.

13. Disputes

a) In the event that our efforts to resolve any issue or dispute amicably, a resolution cannot be reached to your satisfaction, you may elect to have the dispute resolved through binding arbitration in accordance with the rules and procedures of the International Arbitration. The arbitration will be conducted by a neutral arbitrator and will be based on the submission of written documents, without any in-person or oral hearings.

This alternative dispute resolution process is intended to provide a confidential, prompt, and cost-effective means of resolving disputes, while preserving the right of parties to have their disputes resolved by a neutral third-party decision-maker. Before initiating arbitration, it is important to contact us and provide us with the opportunity to address and resolve your concerns. The parties must negotiate in good faith and maintain the confidentiality of all settlement discussions. In the event of arbitration, the amount of any settlement offer made by either party shall not be disclosed to the arbitrator.

14. Governing Law

These terms of service and your use of the Profitify platform and services shall be governed by and construed in accordance with the laws of the jurisdiction in which Profitify is located, without giving effect to any principles of conflicts of law.

15. Entire Agreement

These terms of service constitute the entire Agreement between You and Profitify, and supersedes all prior agreements, negotiations, and understandings relating to the subject matter thereof.

By using Profitify, you acknowledge that you agree to be bound by these terms of service.
